Working Hours and Overtime Regulations in Vietnam
- Working Hours
According to the Labour Code of Vietnam, the normal working hours for employees are 8 hours a day and 48 hours a week based on a 6-day working week. For employees working in heavy, noxious or dangerous conditions, the maximum normal working hours will be 6 hours a day.
Each employee is entitled to rest for at least one day (24 hours in a row) per week. If weekly rest day is not available, the employer shall ensure that each employee has 4 days off every month.
- Overtime
An employer is entitled to require the employees to work overtime under the following conditions:
(1) the employees agree, and (2) overtime hours in a day will not exceed 50% of the normal working hours, with a maximum of 40 hours per month and 200 hours per year, except in some special circumstances as stipulated by the government in which overtime hours are capped at 300 hours per year.
Employers are permitted to organize overtime work of up to 300 hours in a year, including:
(1) Manufacture and/ or processing for export of electric and electronic products; (2) Work requiring employees with high technical qualifications, who are not readily available on the labour market.
In case an employer wishes to extend the overtime hours to more than200 hours per year, it must obtain permission from the relevant labour department.
The employer shall make overtime payment to the employees in accordance with the following standards:
